    Welcome to Austin Moto Adventures ("AMA," "we," "us," or "our"). This document is the agreement between you and Austin Moto Adventures governing your use of our website (austinmotoadventures.com and any associated subdomains), our services, our SMS messaging program, and any related communications. It combines our Terms of Service and our Privacy Policy into a single document. Please read both parts. By using our website, booking a service, opting in to SMS messages, or otherwise engaging with us, you agree to the terms below.

    Part I. Terms of Service

    1. Acceptance of Terms

    These Terms of Service ("Terms") govern your access to and use of the AMA website and services. If you do not agree to these Terms, do not use the website or services. We may update these Terms from time to time; the updated version takes effect when posted with a revised effective date.

    2. Description of Services

    Austin Moto Adventures provides adventure motorcycle training, guided tours and expeditions, lodging at our Burnet, Texas property, equipment rentals, branded events including the TouraTexas Rally, related retail goods, and ancillary services. Detailed descriptions, pricing, and booking-specific terms appear on the relevant pages of our website and in the booking confirmations we send.

    3. SMS Messaging Program ("AMA SMS")

    The Austin Moto Adventures SMS program ("AMA SMS" or the "Program") is an Application-to-Person (A2P) text messaging program operated by Austin Moto Adventures.

    Program description. AMA SMS sends recurring text messages to riders, students, guests, and prospective customers who have opted in. Messages may include training class openings and reminders, tour and expedition announcements, event updates (including the TouraTexas Rally), promotional offers and discounts, new program launches, schedule changes, weather advisories that affect a confirmed booking, and other news related to your relationship with Austin Moto Adventures.

    How to opt in. You may opt in to AMA SMS by entering your mobile phone number into a form on our website, by checking the SMS consent box during a booking, by texting a designated keyword to our number, or by providing your number verbally or in writing to our staff with explicit consent to receive text messages. By opting in, you represent that you are the account holder or an authorized user of the mobile number you provide and that you are at least 18 years of age. Consent to receive AMA SMS is not a condition of purchasing any product or service.

    Message frequency. You will receive up to six (6) messages per month under the Program, with frequency varying based on your activity, bookings, and the season.

    Message and data rates. Message and data rates may apply for any messages sent to you from us and to us from you. Carriers are not liable for delayed or undelivered messages. If you have questions about your text plan or data plan, contact your wireless provider.

    How to opt out. You can cancel AMA SMS at any time by replying STOP to any message from us. After you send STOP, we will send you a confirmation message that you have been unsubscribed. After that, you will no longer receive marketing SMS messages from us. To rejoin, sign up again the same way you did the first time.

    How to get help. Reply HELP to any AMA SMS message to receive assistance, or contact us directly at [email protected] or 512-402-6763.

    Transactional messages. Even after you opt out of marketing SMS by texting STOP, we may still send you transactional messages necessary to deliver the services you have purchased. These include booking confirmations, trip logistics, schedule changes, safety alerts, and day-of communications. These messages are not part of the AMA SMS marketing program.

    Privacy of mobile information. We do not share or sell your mobile phone number, SMS opt-in data, or SMS consent information with any third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent are excluded from any sharing with third parties under any other section of this document. See Part II, Section 17 for full detail.

    4. Bookings, Payments, and Cancellations

    Bookings for training classes, tours, expeditions, cabins, and events are governed by the specific booking-page terms applicable to that product, the deposit and balance schedule disclosed at the time of booking, and any participant release, waiver, or assumption-of-risk document you sign before participating. In the event of a conflict between these Terms and the booking-specific terms or signed waiver, the booking-specific terms and signed waiver control with respect to the subject they address.

    5. Assumption of Risk; Participant Waiver

    Motorcycle training, riding, and tour activities involve inherent risks including, without limitation, the risk of serious bodily injury or death. All participants are required to sign a separate participant release, waiver, and assumption-of-risk agreement before participating in any AMA activity. These Terms do not replace that document and do not waive any participant signature requirement.

    6. Acceptable Use of the Website

    You agree to use our website only for lawful purposes and in a manner that does not infringe on the rights of, restrict, or inhibit anyone else's use of the website. You will not attempt to gain unauthorized access to any portion of the website, interfere with its operation, or use the website to transmit any unlawful, threatening, defamatory, or otherwise objectionable material.

    7. Intellectual Property

    The AMA website and its content, including text, graphics, logos, images, photographs, video, audio, and software, are the property of Austin Moto Adventures or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any portion of the website without our prior written consent.

    8. Third-Party Links and Services

    Our website may link to third-party websites, services, or content. We do not control these third parties and are not responsible for their content, privacy practices, or terms of service. Your use of any third-party site is at your own risk and subject to that site's terms.

    9. Disclaimers

    The website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, to the maximum extent permitted by law. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the website is provided for general informational purposes and is not a substitute for the participant release, waiver, and assumption-of-risk agreement required for any AMA activity.

    10. Limitation of Liability

    To the maximum extent permitted by law, in no event will Austin Moto Adventures, its officers, members, employees, instructors, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the website or services. Our aggregate liability for any claim arising out of or relating to these Terms or the website is limited to the amount you paid us for the service giving rise to the claim in the twelve (12) months preceding the claim.

    11. Indemnification

    You agree to indemnify and hold harmless Austin Moto Adventures and its officers, members, employees, instructors, contractors, and affiliates from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your use of the website or services, or your violation of any law or the rights of any third party.

    12. Governing Law and Venue

    These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the website will be brought exclusively in the state or federal courts located in Burnet County, Texas, and you consent to the personal jurisdiction of those courts.

    13. Changes to These Terms

    We may update these Terms at any time. The updated version takes effect when posted to this page with a revised effective date. Your continued use of the website or services after changes are posted constitutes your acceptance of those changes. Material changes to the SMS Program will be communicated to active subscribers by text or email before they take effect.

    Part II. Privacy Policy

    This Privacy Policy describes how Austin Moto Adventures collects, uses, discloses, and protects your personal information when you access or use our website, submit information through our forms, participate in our services, opt in to our SMS messaging program, or otherwise engage with us. This Privacy Policy is intended to comply with applicable U.S. privacy and communications laws and to satisfy the Privacy Policy requirements for Application-to-Person (A2P) messaging programs.

    14. Information We Collect

    We collect personal information that you voluntarily provide to us, including your name, mobile phone number, email address, mailing address, date preferences for training or tours, emergency contact information, riding experience details, payment information, and any other data you submit through forms, bookings, or inquiries. We may also collect technical data such as your IP address, browser type, device information, and usage patterns when you visit our website.

    15. SMS Communications and Consent

    If you provide your mobile phone number through our website, a booking form, or another channel and opt in to AMA SMS, you consent to receive recurring text messages from us. Messages may include training and tour communications, event updates, scheduling changes, reminders, weather advisories, and promotional offers. Message and data rates may apply. Message frequency will vary based on your interactions with us, up to six (6) messages per month.

    You may opt out of AMA SMS at any time by replying STOP. You may request assistance by replying HELP or by contacting us using the information at the end of this document. Full SMS Program terms appear in Part I, Section 3.

    16. How We Use Your Information

    We use the personal information we collect to respond to inquiries and provide customer support; to schedule, confirm, and manage tour or training bookings; to send transactional and marketing communications, including email and SMS; to improve the quality and functionality of our services and website; to comply with legal obligations; and to enforce our agreements.

    17. Mobile Information and Third-Party Sharing

    Austin Moto Adventures will not share or sell any consumer mobile information (including mobile phone numbers, SMS opt-in data, or SMS consent records) with any third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent records are explicitly excluded from any other category of information that may be shared with third parties under this Privacy Policy. This restriction applies regardless of how we obtained the mobile information.

    With respect to non-mobile information, we may share data with service providers that assist in delivering our services (such as our CRM platform, email marketing platform, scheduling platform, and payment processor). These service providers are bound by contractual obligations to safeguard your information and use it only for authorized purposes. We may also disclose information as required by law, regulation, legal process, or governmental request.

    We do not sell or rent any personal information.

    18. Data Retention

    We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including legal, accounting, or reporting obligations. For customers and registered users, we may retain booking, communication, and customer history data indefinitely unless you request deletion.

    19. Cookies and Tracking Technologies

    We use cookies and similar tracking technologies to enhance user experience, analyze website traffic, and provide personalized content. You can configure your browser settings to decline cookies, but doing so may affect the availability and functionality of certain features on our website.

    20. Embedded Content from Third Parties

    23. International Data Transfers

    Our website and services are intended for users in the United States. If you access our services from outside the U.S., you acknowledge that your data may be transferred to, stored, and processed in the United States and that U.S. privacy laws may differ from those in your jurisdiction.

    24. Children's Privacy

    Our services are not directed to individuals under the age of 13. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected data from a child under 13, we will take reasonable steps to delete it. AMA activities are limited to participants 18 and over or to minors with the signed consent of a parent or legal guardian, in accordance with the participant waiver applicable to that activity.

    25. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. The updated version takes effect when posted to this page with a revised effective date. Material changes to the SMS Program privacy practices will be communicated to active subscribers by text or email before they take effect.
